MARBELLACAR.COM RENTAL CONDITIONS
RESTRICTIONS BY AGE AND DRIVING LICENSE
  • The minimum age of the driver is 18 years.
  • The driver must be the holder of a driving license approved in Spain and within EU and in force.
  • Drivers under 25 years of age must take out additional insurance of €5 per day.
DOCUMENTATION TO BE DELIVERED AT THE TIME OF PICK-UP OF THE VEHICLE
  • To pick up the rental vehicle, it is essential to present a valid ID or passport, driver’s license and a valid credit or debit card in the name of the driver.
  • We accept payments by credit and debit card of the VISA and MasterCard type. We also accept cash payments as long as they are accompanied by a valid debit or credit card in the name of the driver. The owner of the credit card must be one of the authorized drivers. We do not accept payments with prepaid cards or electronic use.
INCLUDED IN THE RENTAL PRICE
  • VAT, fees and local taxes.
  • Insurance Basic plan: The insurance will cover damage to the vehicle with a deductible of €500 as well as damage to third parties and civil liability.
  • All our rentals have limited mileage 250 km per day calculated together for the rental period (total exceeded milage will have a surcharge of €10 per additional 100 km).
 
NOT INCLUDED IN THE RENTAL PRICE
  • Airport service (airport delivery and pick up €45 each way, free delivery and pick up in Marbella, for other destinations please consult with an agent)
  • Baby/child seats and booster seats: €3 euros per day for each seat delivered and by contract. Their installation will always be the customer’s responsibility
In the event of an accident or damage to the vehicle, it is mandatory for the client to fill out an accident/damage report and deliver it to our office. Also, in case of theft of the vehicle, the client is obliged to report it to the Police and deliver the report to our office, as well as return the vehicle key. We are not responsible for the commissions charged by your bank, if any.
For each accident or damage report processing that we have to carry out, an additional €60 (VAT included) will be charged for the management of the accident processing. If the insurance determines that the incident was not the Client’s responsibility, the €60 (VAT included) will be returned.
Cars Club reserves the right to modify any of the above points if it deems it necessary to guarantee the safety of the vehicle.
OBJECT OF THE CONTRACT
The rental of a car is not necessarily linked to a specific vehicle but to a group of similar vehicles, in terms of technical characteristics and habitability.
The Client acknowledges that he receives the vehicle described in the Contract, clean and in the conditions of conservation and operation, damages, state of the fuel tank and auxiliary equipment specified, which if not referred to, will be considered fit for use.
CONTRACT PERIOD
The duration of the Rental Agreement will be that which appears on the front of the same, specifying the date and time of delivery and return of the vehicle.
Rental day refers to a period of 24 hours from the start time of the rental, counting on the return with a courtesy period of 60 minutes.
The maximum duration of the Rental Agreement will be 30 days unless otherwise agreed.
If the Client decides to end the rental before the date indicated in the Contract, no refund will be made for the early return.
Likewise, in the event that it was MARBELLACAR.COM that unilaterally terminated the rental prior to the date indicated in the contract for reasons not attributable to the lessee and formally required the delivery of the vehicle and it did so; the client will have the right to receive from MARBELLACAR.COM refund corresponding to the days not enjoyed using the vehicle as compensation.
USE OF THE VEHICLE
The Client undertakes to keep the vehicle in good condition and, without prejudice to the obligations that may appear in other clauses of this Contract, to:
  • Use and drive the vehicle diligently, respecting the Law on Traffic, Circulation of Motor Vehicles and Road Safety and other applicable provisions. Any negligence for not respecting the rules will imply that the insurance coverage that you have contracted in terms of damage to the leased vehicle will not apply.
  • Without limiting the generality of the provisions of the preceding paragraph, you agree not to drive the vehicle under the influence of alcoholic beverages, narcotics, psychotropics, stimulants or similar substances or in states of decreased driving ability, such as fatigue or illness, nor allow the driving of the vehicle to whoever is in such circumstances.
  • Do not use the vehicle for illegal purposes.
  • Not allow the driving of the vehicle by any person other than the Client himself or the additional drivers specified on the face of the Contract.
  • Do not carry more passengers than those specified by the vehicle manufacturer or permitted by law, or transport animals.
  • Do not use the vehicle to move, push or tow other vehicles, trailers or objects.
  • Do not circulate on roads or other places that, due to their poor state, may cause damage to the vehicle.
  • Do not participate with the vehicle in competitions, contests, training or tests of resistance of materials, accessories or products for automobiles.
  • Do not use in the vehicle gasoline or fuel of a quality or characteristics other than those that correspond in accordance with what is indicated by the manufacturer of each type of vehicle.
  • Have the vehicle properly parked and closed when not in use.
  • Do not use the vehicle to load or transport goods of any kind, or mount a roof rack without authorization.
  • Do not tamper with the vehicle’s odometer in any way.
  • Do not use the vehicle for public passenger transport, nor to give driving courses, nor for courier services or merchandise distribution, nor dedicate it to commercial or industrial activities, nor to any type of activity that implies sublease of the vehicle.
  • Do not move the vehicle outside the Iberian Peninsula (also excluding Gibraltar and Portugal) unless prior written authorization has been obtained from MARBELLACAR.COM.
  • The Client must be in possession of a valid and approved driving license in Spain and with a minimum age of 1 year, the Client being directly responsible for these events, keeping MARBELLACAR.COM harmless under any concept.
Improper use of the vehicle will make the Client directly responsible for any damage caused to the vehicle or to third parties.
Any case that does not comply with the provisions of this Contract will be understood as improper use in which case the Client will be liable for all damages caused to the vehicle as well as other damages caused to Ecorent Malaga.
VEHICLE RETURN
The return of the vehicle must take place at the branch, date and time stipulated in the Rental Agreement. The vehicle will be returned by the Client in the same conditions in which it was delivered, together with all its documents, auxiliary equipment, tires, tools and accessories.
The Customer may not alter any technical characteristic of the vehicle, keys, equipment, tools and/or accessories thereof, nor make any changes to its exterior and/or interior appearance. If it does so, the Client must bear all the necessary expenses to return the car to its original condition, without prejudice to the damages caused to MARBELLACAR.COM derived from the reconditioning for the time that the vehicle had to be immobilized, as well as any others caused to MARBELLACAR.COM.
Late return/delivery of the vehicle: In case of return by the client of the vehicle on a date, time or place other than that indicated in the contract, the rental of an extra day will be charged at the current daily rate for each day or portion of the day. of delay in the delivery of the vehicle. A grace period of 60 minutes is granted for the delivery of the vehicle from the scheduled time. Likewise, a penalty is established as compensation of €35 for each day of delay.
If the Client returns or abandons the vehicle in a different place than the one indicated in the Contract, MARBELLACAR.COM may also demand the costs incurred for transfers, cranes, tolls, storage and custody.
In the event that MARBELLACAR.COM is late in delivering the vehicle for more than 120 minutes from the signing of the rental contract, the customer will be compensated for an extra day at the current daily rate for each day or portion of a day of delay in delivery. vehicle. Likewise, a penalty is established as compensation of €35 for each day of delay.
EXTENSION OF THE CONTRACT TERM
If the Client wishes to extend the rental, he may do so by appearing at one of the MARBELLACAR.COM offices in order to sign the extension of its duration and proceed with the corresponding payments. This extension will be subject to the availability of the vehicles.
The unilateral extension by the Client will be considered as an unauthorized use of the vehicle for the purposes of the Client’s responsibility for any damage to the vehicle, also having the same consideration as the non-return of the vehicle within the agreed period.
VEHICLE AND FUEL RETURN SYSTEM
The purpose of the vehicle return system is to verify that the return of the vehicle is carried out in the initially agreed manner. For this, technicians from the leasing company (MARBELLACAR.COM) will carry out a management control in which two factors will be checked essentially: the condition of the car in relation to the possible damage it may have suffered during the rental period, the fuel level and the mileage.
1. Condition of the vehicle
The vehicle must be returned by the client in the same state of conservation in which it was delivered. Our staff will inspect the condition of the vehicle and note any new damage. You will be required to sign a damage inspection as proof of acceptance.
In the event that the vehicle is not returned in the same state of conservation, the Client must also pay compensation for the paralysis of the vehicle as a result of the damage suffered; we refer to the section “return of the vehicle”.
2. Fuel
The vehicle will be delivered with a full tank and must be returned with the same fuel.
3. Mileage 
All our rentals have limited mileage 250 km per day calculated together for the rental period (total exceeded milage will have a surcharge of €10 per additional 100 km).
PAYMENT
  • The accepted means of payment are credit and debit cards of the Visa and MasterCard type.
  • Prepaid cards and virtual cards will not be accepted.
  • The holder of the bank card with which the rental payment is made must be the holder of the contract and he must be present at the time of collection.
  • The cardholder, who will be the same as the contract holder, will be responsible for the payment of any extra caused by the additional drivers of the contract.
  • The payer must ensure that their bank card has sufficient funds at the time of vehicle collection to be able to collect the rental with all the contracted options and, in addition, if applicable, block the amount of the deposit corresponding to the group of the rented vehicle.
  • Fines: The Client is responsible for paying the fines for circulation, improper parking or other infractions incurred during the rental period of the vehicle and during the time that it has been in its possession until its effective delivery. MARBELLACAR.COM will charge the amount of €45 (VAT included) for management and processing expenses, as it is obliged to communicate the Client’s data as well as the rental contract data to the relevant authorities within the established legal term. This fee does not include the payment of the fine.
  • Special cleaning of the vehicle: The rental price includes a standard cleaning of the vehicle. However, in the event that the vehicle requires a special cleaning due to delivery in an inadequate state of the vehicle, MARBELLACAR.COM will be forced to charge an amount of up to €100-200.
  • The amount or difference in the value of any spare wheel, tires, tools, accessories, documentation, keys or radio equipment that is missing from the vehicle at the end of the rental or has been replaced by another, expressly clarifying that said faults or substitutions are not covered for any insurance policy, being the Client responsible for them.
  • The costs of repairing damage to the vehicle in the event of an accident, when:
  • The vehicle would not have been used based on the established conditions
  • The accident report had not been completed and sent to MARBELLACAR.COM within the stipulated period, or else it does not conform to the reality of the events that occurred.
  • That the corresponding extra insurance had not been contracted.
HOW TO CANCEL YOUR RESERVATION WITH ONLINE PAYMENT
  • If the cancellation is made more than 48 hours prior to the time of delivery of the vehicle, all charges will be refunded.
  • If the cancellation is made less than 48 hours before the time of delivery of the vehicle, no charge will be returned.
  • If the offer is non-refundable, the amount charged for the reservation will not be returned.
INSURANCE
When you rent a vehicle at MARBELLACAR.COM, your rental is covered by our insurance, regardless of the protection plan you have chosen. In addition, this insurance is accompanied by 24/7 roadside assistance that takes care of the vehicle and its passengers in the event of an accident, breakdown or theft.
Protection plans: Basic and Full
When you book your rental, you can generally choose between 2 different protection plans: Basic or Full. However, the Full option may not be available depending on certain conditions such as your age, your rental history and the category of the car you are reserving.
For rentals that do not include the Full plan, a deposit will be taken as a guarantee. The amount of the deposit varies depending on the rented vehicle, starting from €250.
Insurance guarantees and exclusions
MARBELLACAR.COM Full plan insurance covers:
  • Damage to the exterior of the vehicle
  • Damage to a third party
  • Vehicle theft
  • Fire
  • Damaged glass
MARBELLACAR.COM insurance does not cover:
  • Fuel bug
  • Lost or damaged keys
  • Damage inside the vehicle
  • Tire damage
Important conditions
Accident with a known third party:
In the event of an accident with a third party for which you are not responsible, the deductible will initially be applied (according to the protection plan purchased). You will be reimbursed as soon as the insurance confirms that you are not responsible or once the third party has accepted the appeal filed against them. This duration is out of our control and can last several weeks.
Accident with an unidentified third party:
In the event of an accident with an unidentified third party, you will be responsible for the damages.
How could I be denied insurance coverage?
Whatever happens, you must comply with all our insurance conditions. You may be denied insurance coverage if:
  • The driver does not act as the main driver for the entire rental
  • The rental was not paid online with a form of payment in the name of the driver
  • The rental agreement is not signed by the driver
  • The driver is not present at the return of the vehicle
  • The driver returns the car outside the rental period
  • The car was taken out of the authorized countries during the rental
Please also note that some devices and bugs are not insured, and any damage will be your responsibility:
  • Damage to the interior of the vehicle (seats, glove box, etc.)
  • Fuel errors
  • Loss of keys
  • Any breakup as a result of misbehaviour on your behalf
  • Any aggravation of an initial damage or breakdown
What is the franchise?
The excess is the maximum amount you would pay for any damage to the vehicle. The rest of the repair costs are covered by insurance.
PERSONAL ITEMS
MARBELLACAR.COM is not responsible for stolen, forgotten or lost items inside the vehicle.
LEGISLATION
This contract will be governed and interpreted in accordance with Spanish law. MARBELLACAR.COM declares its intention to settle any difference amicably. If this is not possible, any disagreement that may arise between MARBELLACAR.COM and the Client will be submitted to the jurisdiction of the place where the rental began.

DATA PROTECTION
In accordance with the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, we inform you about the incorporation of your personal data into a file owned by MARBELLACAR.COM in order to facilitate the provision of the vehicle rental and/or sale service.
Likewise, we inform you that MARBELLACAR.COM has adopted technical and organizational measures that guarantee the security of personal data and prevent their alteration, treatment or unauthorized access, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed, all in accordance with the provisions of Royal Decree 1720/2007, of December 21, which approves the regulations for the development of the Organic Law on Data Protection. Likewise, we request your consent to send you informative communications through ordinary mail / fax / email, about the products and services offered by our company. We inform you that your data will be transferred, by legal imperative, to the State Security Forces and Bodies, to prevent crime and ensure national security.
